FURSUIT/COSPLAY TOS

IN ORDER TO COMMISSION:
-You must agree to all of the below Terms of Service.
-You must be 18 years or older in order to commission anything above $50.
-You must send me a photo of a valid ID in order to commission. Valid IDs include but are not limited to: Drivers License, State ID, Government/ Military ID. The ID must include a photo of you and your date of birth.
PRICING:
-Prices are subject to change.
-The price of a product will fluctuate depending on the cost of materials, skill level, type, and demand of the product.
-Prices are set by me, the owner of PotatoMonster Cosplay, and will not be changed unless I decide so.
-The shown prices of products are starting prices and are subject to change.
QUOTES:
-Quotes are given before a product is paid for.
-Quotes are subject to change.
-A quote must be approved by me, the owner of PotatoMonster Cosplay, in order to be valid.
PAYMENT:
-All transactions are to be made through Paypal services.
-A 50% downpayment is needed to secure your slot for a commission/product. 100% of the commission must be fully paid before I will start your commission.
-Invoices are sent to the buyer to be paid.
-A total of 3 invoices are sent. The 50% downpayment, the remaining 50%, and the shipping costs.
PAYMENT PLANS:
-Payments plans are available for all products or groups of products $100 and over. Products $99 and below must be paid in full and are not eligible for payment plans.
For products $100- $399:
-The 50% downpayment is to be paid in a single payment.
-The remaining 50% is to be paid in a maximum of two payments total.
For products $400 +:
-The 50% downpayment is to be paid in a maximum of two payments total.
-The remaining 50% is to be paid in a maximum of four payments total.
-Payments are due by the 1st of each month following the first downpayment payment.
-A payment can be made at anytime during a month. Multiple payments during a month are accepted.
MISSED PAYMENTS:
-Missed payments, or no payment during a payment month, will result in extra fees added onto your total bill.
-If extra fees are added due to a missed payment, these fees must be paid for before any work is started.
-If a payment is missed an extra $20 fee will be added. If a payment is missed a second time, the $20 fee will be added again, along with an extra $5 for everyday the payment goes unpaid.
-If three payments are missed your commission will be canceled and you will be refunded according to the Cancellations and Refunds section of this Terms of Service.
SHIPPING:
-Buyer pays shipping.
-Shipping is not a part of the quoted price and will be calculated once your product is complete.
-Shipping costs must be fully paid before I will send your product.
-I will need your full mailing address in order to ship your product.
-Shipping is done primarily through USPS and UPS services.
-A tracking number will be given to you once I deliver the package to the post office.
-I will send photos of the box and all products inside before shipping your product.
-I am not responsible for any lost or damaged mail/products.
-Once a package leaves my care there is nothing I can do for it.
-Shipping internationally is accepted. However please note that shipping internationally is expensive, and depending on your country, will add additional fees you must pay to receive your package.
QUEUE:
-A queue is the list, or order, in which I work on commissions.
-Your spot in the queue is dependant on when your product is fully paid for. Those who can pay in full will be at the top of the queue. Those who need payment plans will be added onto the queue as they complete their payments in full.
-When your spot in the queue is ready to be worked on, I will notify you by email.
-Products before you in the queue will be worked on and completed before I will start on yours.
-When you are added to the queue does not reflect when your product will be started.
WIPs AND COMMUNICATION:
-Communication is done primarily through the email you have provided me.
-WIPs (work in progress) photos will start to be given once your spot in the queue is reached and I have work to show you. If I have WIPs to show you I will send them.
-In the case you find something on your product that needs to be fixed/changed (within reason), I need to be informed immediately before I move onto the next steps.
-Failure to notify me of something that needs to be changed could result in additional fees to go back and fix it if I have moved onto the next steps.
-Please remember that this is a business transaction. If you have questions/concerns/compliments about the commission feel free to message me. However, please do not message me to engage in small talk, or private/personal matters. I will not reply to this type of messaging.
-If you have a question/concern/compliment please say what you have to say. Messages that only include one word, such as “Hi/Hello/Hey” and nothing else will be ignored.
-Please allow up to one week, unless stated otherwise by me, for any messages to be replied to. In the case that I am out of town, or will be away from any internet for a long period of time, I will let all clients know.
HARASSMENT:
-Harassment is not tolerated under any circumstances.
-Any form of harassment could result in the cancelation of your commission, as well as a blacklisting and/or a beware depending on the situation.
-Depending on the situation, an appropriate legal team could be brought into the matter.
-Forms of harassment include but are not limited to:
Constantly asking for updates/WIPs of your commission (hourly/daily).
Spam or constantly messaging me.
Rude/ immature behavior.
Aggressive or sexual/ innapropriate behavior.
Racist/ sexist behavior.
Slander or defamation against me and/or my business.
Asking for private information.
Any attempt to chargeback/ refund yourself.
DEADLINES/ TIME PERIODS:
-I do not accept deadlines of any kind.
-The time a product takes to make depends on the amount, complexity, etc, of the individual product.
-Your product is started when I get to your spot in the queue and not when you are added to the queue. Any time estimates given will be based on this.
-Time estimates can be given once the product is closer to completion.
-Any product can take anywhere from a week to 1 year to make.
CANCELLATIONS AND REFUNDS:
-I reserve the right to cancel any commission of a product for any reason.
-Any part of the 50% downpayment of a product is nonrefundable, period.
-If I cancel a commission or you cancel your commission:
If only the downpayment has been paid, you will not receive any refund as any part of the 50% downpayment is nonrefundable.
If you have fully paid but no work has been done, you will be refunded the 50% that is not the downpayment.
If you have fully paid but work has been started, your refund will vary depending on what work has been done and what materials have been bought.
-Refunds due to not liking my style of making a product are not eligible for a refund.
-In the case that you try to chargeback, or refund yourself without permission, I hold the right to:
Send Paypal services all proof of our transactions including our emails, conversations, proof of purchase, etc.
Bring in an appropriate legal team to fix the situation.
-Chargebacks are not allowed and can result in blacklisting, a beware put up on you, and possibly bringing in an appropriate legal team depending on the situation.
-All refunds will be sent back to you by me if they are needed.
REFERENCE SHEETS/IMAGES:
-A clear and colored reference image is needed in order to commission a product.
-A clear and colored reference can include, but it not limited to:
A front, back, and side view of the character/clothes/weapons/props being commissioned.
Fully colored with clear markings.
Clear lines, not blurry.
Any extra items drawn and colored clearly.
-References that are unclear, unfinished, uncolored, blurry, etc, will not be accepted.
MEASUREMENTS:
-Measurements will be needed for most wearable products.
-Measurements must be made with a fabric tape measure, as these give the most accurate measurements.
-Measurements must be given in either inches or centimeters.
-I must have all required measurements for a product before I will start it.
-When measuring, measurements must be exact with no extra length added.
-Other forms of measuring/ measurements will not be accepted as I do not know if they are accurate.
-I am not responsible for any product that does not fit due to inaccurate measurements.
DUCKTAPE DUMMIES:
-A ducktape dummy, or DTD, is required for products such as bodysuits, legs, and/or clothing.
-A video of how to make a proper DTD will be sent for you to follow.
-DTDs must be made on a painters suit with ducktape.
-DTDs using towels, clear wrap, paper, clear tape, masking tape, painters tape, will not be accepted.
-I require these items to be clearly marked on your DTD before you send it to me:
Hash marks along the cut line, so I can tape the dummy back together.
Your characters name.
Your name and email.
Any social media usernames I can contact you by.
-Let me know if you want your DTD back before you ship it. If you do not, or I get no response, it will be thrown away afterwards.
-I am not responsible for any product that does not fit due to the DTD being done wrong.
-If your DTD breaks I will require you to make another and send it before I will continue working.
WARRANTIES:
-All products come with a 3 month warranty.
-During the first 3 months after receiving your product you can get free repairs done, but you must pay shipping both ways.
-Doing your own repairs on the suit during this time will void the warranty and you will have to pay both for the repairs and the shipping costs, or you can do the repairs yourself.
-In the case that something breaks or is unfunctional upon receiving,and you do not wish for me to repair it, you must notify me within the first 3 days of owning the suit to receive any kind of refund. Video proof of the unboxing and fitting is required. A refund of any sort for this will be no more than 30% the total cost (not including shipping).
-If I forget to send an item, I can either send it to you or refund you for that items cost.
SPHs/ NSFW:
-SPHs, or specially placed holes, can be added to your product upon request for an added fee. However, this will void the warranty on your product and I will not do any repairs.
-Any sort of NSFW, or sexual activity in your product, will void the warranty and I will not do any repairs.
-I understand that most products can be washed very well, but I would prefer not to receive them for repairs since I can not accurately tell if a person has honestly washed their product. I hold no prejudice to those who choose to use their product for NSFW activity, as these are adults and can do what they want with the product they bought.
-The actions and activities of those who have bought a product from me do not reflect my own actions and activities.
WHAT I WILL NOT MAKE:
-I hold the right to accept or reject any commission as I see fit.
-Subjects I will not make are, but not limited to:
Anything to do with racism/ sexism.
Any kind of genitalia.
Inappropriate symbols.
ANIMALS IN THE WORKPLACE:
-If you are highly allergic to dog and/or cat fur do not commission me.
-I own a dog, cat, and lizard in my home.
-While I do my best to keep animal hair out of my workspace it is impossible to make it completely hair free.
-With this as your warning, I am not responsible for any allergic reaction due to pet hair/dander from your product.
INJURIES:
-I am not responsible for any injuries acquired while wearing or using my products.
